Bail Bonds are a method that is used to allow defendants to be released from jail while they await their court date. Although a person has the right to post their own bail amount, many people do not have the amount of money to take care of paying this amount, since bail can sometimes be thousands of dollars. When a defendant or their family members cannot pay for bail, they can hire a bails bondsman to sign a bond on their behalf so they can be released from jail. There are certain responsibilities a defendant has when they have been bonded out of jail and it is crucial they meet these responsibilities to ensure they do not experience issues with the courts or their bonding agent.

  • A fee must be paid before a bondsman will sign a bond. This amount is mandated by the state and cannot be changed by the bondsman. The typical rate is ten percent. The defendant or another person must pay this amount or put up collateral such as real estate, jewelry, cars, credit cards, stocks, bonds, or bank accounts. Once this amount is paid, it is not refundable even if a person is found not guilty when they stand trial. It behooves a person to ask for a rate chart so they can fully understand how they are being charged.
  • In many cases, a person is not allowed to leave the state or county they reside in. If the court has stated they must stay in the county, a person will need to get written permission from the court and the bails bondsman before they attempt to travel outside of the county or state. Failure to do so could result in arrest and further charges.
  • Once a person has been released from jail, they are required to show up for any and all court dates. It is the responsibility of the defendant to keep up with these dates so they remain compliant with their bond agreement. If a person does not show up for court, they can be arrested or hunted by a bounty hunter on behalf of the bondsman.
